Please read these Terms and Conditions ("Terms," "Terms and Conditions") carefully before using the Mama T's Aquatics website (the "Site") operated by Mama T's Aquatics ("us," "we," or "our")

1. Acceptance of Terms

By accessing and using the Site, you confirm your acceptance of and agreement to be bound by these Terms and Conditions. If you disagree with any parts of the terms, then you do not have permission to access the Site. These Terms apply to all visitors, users, and others who access or use the Site.

2. Intellectual Property Rights

2.1 The content, design, graphics, compilation, magnetic translation, digital conversion, and other matters related to the Site are protected under applicable copyrights, trademarks, and other proprietary (including but not limited to intellectual property) rights. All such rights are reserved. The copying, use, or publication by Mama T's Aquatics of any such matters or any part of the Site is strictly prohibited.

2.2 Limited Access

You are granted a non-exclusive, non-transferable, revocable license to access and use the Site strictly in accordance with these Terms and Conditions. As a condition of your use of the Site, you warrant Mama T's Aquatics that you will not use the Site for any purpose that is unlawful or prohibited by these Terms.

2.3. Prohibited users

You agree to notify, copy, distribute, transmit, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Site, unless expressly permitted by these Terms or by written consent from Mama T's Aquatics.

3.1 General Disclaimer

The information provided on the Mama T's Aquatics website is for informational purposes only. The website is provided  on an "as is" and "as available" basis. Mama T's Aquatics makes no representations or warranties of any kind, express or implied, as to the operations of the Site or the information, content, materials, or products included on the Site. You expressly agree that your use of the Site is at your sole risk. 

3.2 Specific Aquatics Disclaimer

Mama T's Aquatics does not warrant that any information regarding the care, maintenance, or health of aquatic organisms, including fish or plants, is professional medical or veterinary advice.  You should always seek the advice of a qualified professional, such as a veterinarian or aquatic specialist, before taking any action that may affect the health of your aquatic environment.  Adding any fish, shrimp, snail, or plants to your aquatic environment it is best to quarantine in a separate tank once received Mama T's Aquatics is not responsible for any of your livestock if something were to happen in the event of adding livestock to your tank this includes refunds, compensation of livestock, that was previously owned by you.

 4. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Mama T's Aquatics, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other tangible losses, resulting from:

• (i) Your access to or use of or inability to access or use the Site;
• (ii) Any conduct or content of any third party on the Site;
• (iii) Any content obtained from the Site; and 
• (iv) Unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

5.  User Obligations and Prohibited Conduct

5.1 Lawful use 

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Site.

5.2 Prohibitive Activities 

You specifically agree not to do any of the following:

• A. Use the Site in any way that violates any applicable national, state, local, or international law or regulation.
• B. Post or transmit any material which is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, or scandalous.
• C. Use the Site to distribute or upload any material that contains malicious software, viruses, or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware. 
• D. Interfere with or disrupt the Site or servers or networks connected to the Site.
• E. Attempt to gain unauthorized access to the Site, other accounts, computer systems, or networks connected to the Site.
• F. Harvest or otherwise collect information about users, including email addresses, without their consent. 
• G. Use the Site to engage in any unauthorized commercial activities, including, without limitation, spamming, bulk emailing, or any other form of solicitation.

5.3 Content Monitoring 

Mama T's Aquatics reserves the right, but does not have the obligation, to monitor all materials posted to this Site.  We reserve the right to remove any materials that we, in our sole discretion, find to be objectionable or in violation of these Terms. 

6. User Accounts and Security

6.1 Account Creation

To access certain features of the Site, you may be required to register an account. When creating an account, you agree to:

• A. Provide current, complete, and accurate information as requested by the registration form.
• B. Maintain and promptly update the registration data to keep it current and accurate.

6.2 Account Responsibilities

You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify Mama T's Aquatics immediately of any unauthorized us of your account or any other breach of security.

6.3 Account Liability

Mama T's Aquatics will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by Mama T's Aquatics or another party due to someone else using your account or password.

6.4 Suspension and Termination

Mama T's Aquatics reserves the right, in its sole discretion, to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof) if you provide any information that is untrue, inaccurate, not current, or incomplete, or if we have such reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, or for any violation of these Terms.

7.1 External Links

The site may contain links to websites and resources operated by third parties (collectively, "Third Party Sites"). These links are provided for your convenience only. Mama T's Aquatics has no control over the content of Third-Party Sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them.

7.2 No Endorsement

The inclusion of any link does not imply endorsement by Mama T's Aquatics of Third-Party Site or any association with its operators. You access Third-Party Sites at your own risk and subject to the terms and conditions of use for such items.

7.3 Content Accuracy

Any options, advice, statements, services, offers, or other information or content expressed or made available by third parties, including information providers and users, are those of the respective author(s) or distributor(s) and not of Mama T's Aquatics.

9. Termination

9.1 Termination by Mama T's Aquatics

Mama T's Aquatics may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms and Conditions.

9.2 Effect of Termination

Upon termination, your right to use the Site will immediately cease. If you wish to terminate your account (if applicable), you may simply discontinue using the Site. All provisions of the Terms which by their nature should survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability, shall survive termination. 

10. Governing Law and Jurisdiction 

10.1 Governing Law

These Terms shall be governed and construed in accordance with the laws of Illinois/United States, without regard to its conflict of law provisions. 

10.2 Jurisdiction

You agree that any legal action or proceedings relating to these Terms and Conditions shall be instituted in a state or federal court sitting in Whiteside, Illinois/Sterling, and you hereby 

consent and submit to the exclusive jurisdiction of such courts.

State that will govern these terms State of Illinois, United States. And any legal disputes will be resolved in Sterling, State of Illinois. 

11. Changes to Terms 

11.1 Right to Modify

Mama T's Aquatics reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any terms taking effect. What constitutes a material change will be determined at our sole discretion.

11.2 Acceptance of Changes

By continuing to access or use our Site after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Site.
